Improving Accessibility of the Legal System for Aboriginal and Torres Strait Islander Victims : Survivors of Family Violence and Sexual Assault

This paper focuses on the inability of the legal system to adequately address Indigenous domestic and family violence issues. Three key areas of focus to improve issues for Indigenous people as victims/survivors of domestic violence and sexual assault include: strengthening law and justice outcomes; strengthening on the ground service provision; and improving accessibility of the legal system. Other issues which cause a lack of trust in the criminal justice system for Indigenous Australians are further identified. Family law, child protection, family violence law, victims assistance, the impact of being a witness, police responses, and restorative justice are specifically explored with research and case studies being presented to support the recommendations.
